Kidnapping Defense Attorney in Merced, CA
Nearly Two Decades of Felony Defense. Every Case Handled Personally.
A kidnapping charge in California is one of the most serious felonies you can face. It’s charged as a strike offense, carries potential sentences ranging from years to life in prison, and can follow you permanently. If you or someone you love has been charged in Merced County, the decisions made in the next few days matter enormously.
I’m Christopher Loethen. My practice is built entirely around criminal defense, and I handle each case personally from first contact through resolution. Kidnapping cases are heard in the Merced County Superior Court Criminal Division, and I know that courtroom well after nearly two decades of felony defense work in this county.
Call me at (209) 546-6192 now for a free, confidential consultation. I’m available 24/7, offer virtual meetings, and provide Spanish-language services.
Why Clients Facing Serious Felony Charges Come to Me
I started my career as a public defender, and I’ve never practiced on the prosecution side. For nearly twenty years, I’ve stood only with the accused. That’s not a marketing line. It shapes how I think about every case, how I read evidence, and how I approach a jury. I’ve handled ten thousand cases over the course of my career, including the most serious felonies in Merced County: murder, sex offenses, violent crimes, and strike cases.
My reputation here has been built entirely through word of mouth. Clients don’t find me through advertising. They find me because someone they trust told them to call. When you hire me, you get me. No handoffs to junior associates, no case managers running your file. I prepare meticulously and advocate directly, because with charges that carry life sentences, there’s no room for anything less.
What California Kidnapping Charges Actually Mean
California Penal Code 207 defines simple kidnapping as moving another person a substantial distance against their will using force or fear. There’s no fixed number of feet that satisfies the “substantial distance” element. Courts look at whether the movement increased the victim’s risk of harm, reduced their chance of escape, or made it harder to detect the crime. Every case turns on its specific facts.
To convict under PC 207, the prosecution must prove three things beyond a reasonable doubt: that the victim was moved a substantial distance, that the movement was against their will, and that force or fear was used. Each element is a potential point of challenge.
Aggravated Kidnapping & Enhanced Charges
Aggravated Kidnapping Under PC 209:
When kidnapping is committed for ransom, extortion, or in connection with another felony such as robbery or rape, it’s charged under California Penal Code 209 and carries a sentence of life in prison. Kidnapping during a carjacking, charged under PC 209.5, also carries a life sentence with the possibility of parole. Kidnapping a victim under age 14 triggers enhanced sentencing under PC 208.
Strike Consequences, Lesser Charges & Immigration
Strike Offense Consequences:
Kidnapping is a violent felony and a strike under California’s Three Strikes Law. A prior strike conviction doubles the sentence on any new felony. Two prior strikes can result in a mandatory 25-to-life sentence. Understanding where this charge falls in your criminal history is one of the first things I assess.
False Imprisonment as a Lesser Charge:
False imprisonment under PC 236 doesn’t require proof of movement and carries significantly lower penalties. In cases where the prosecution can’t establish substantial movement, false imprisonment may be a realistic outcome to pursue.
Immigration Consequences:
For non-citizens in Merced, a kidnapping conviction can be devastating beyond the criminal sentence. Because kidnapping is considered a crime of violence, it may qualify as an aggravated felony under federal immigration law, making deportation a very real risk. This is a consequence I address directly with any client for whom it’s relevant.
